Terms of Service

1. Acceptance of Terms

By accessing or using Nook ("the Service"), operated by Nook Widget Atelier ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Nook provides an embeddable widget that places a real person on your website as tap-to-play video answers. The Service includes a dashboard for recording and managing questions and answers, AI assistance for drafting questions and scripts, analytics, lead capture, a CDN for widget delivery, and associated APIs.

3. Accounts

You must create an account to use Nook. You are responsible for maintaining the security of your account credentials. You must provide accurate and complete information during registration. You must be at least 18 years old to use the Service.

4. Plans and Billing

Nook offers the following plans:

Payment processor. Paid subscriptions are processed by our payment provider, DodoPayments, which acts as merchant of record. By subscribing you also agree to the payment provider's terms. We do not store your full card details.

Automatic renewal. Pro is a recurring subscription. It renews automatically at the end of each billing period (monthly or annual, as selected) at the then-current price, and you authorize us and our payment provider to charge your payment method for each renewal until you cancel. There is no free trial; you are charged when you subscribe.

Cancellation. You may cancel at any time from the billing portal in your dashboard. Cancellation stops future renewals; your Pro access continues until the end of the period you have already paid for, after which the account reverts to the Free plan. We do not provide prorated refunds for the unused portion of a period except as stated below.

Refunds. If you are not satisfied, contact us at [email protected] within 14 days of a charge and we will issue a refund of that charge. Beyond 14 days, charges are non-refundable except where required by law.

Price changes. We may change plan pricing or features. Changes to recurring prices take effect at your next renewal, and we will give reasonable advance notice by email or in-app. Continuing your subscription after a change takes effect constitutes acceptance of the new price.

Taxes. Prices are exclusive of applicable taxes (such as VAT or sales tax), which may be added at checkout where required.

Failed payments and downgrades. If a renewal payment fails, we may retry it and may suspend or downgrade your account to the Free plan until payment succeeds. Downgrading to Free may disable Pro features and hide content that exceeds Free plan limits (for example, questions beyond the included amount); your data is retained and restored if you upgrade again.

6. Intellectual Property

Nook and its original content, features, and functionality are owned by Nook Widget Atelier. You retain ownership of any content you upload or configure through the Service (images, text, audio). By using Nook, you grant us a limited license to host and deliver your content via our widget infrastructure.

7. Availability and Uptime

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for any downtime, data loss, or service interruptions. Scheduled maintenance will be communicated in advance when possible.

8. Limitation of Liability

To the maximum extent permitted by law, Nook Widget Atelier shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may delete your account at any time through the dashboard. We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
